Elder Law

During the course of Hart Bell’s 130 years of service to our community, we have assisted our clients throughout the various stages of their lives. These services include planning for the possibility of disability, incapacity, home healthcare and/or nursing home placement. We also have a specific expertise in advising clients on the legal requirements to qualify for government benefits, including Medicaid. In our role as your attorney, we will provide you legal advice on such issues as long term care insurance, long term living arrangements and facility placement.

We also offer services including the drafting the necessary documents which provide authority for a client’s named designee to act on the client’s behalf in financial and legal matters. We also prepare the required documentation which provide our clients with the ability to choose the person who will make critical healthcare decisions on their behalf when they are unable to decide for themselves, as well as sophisticated “Living Wills” which specifically outline what the client’s wishes are with respect to life prolonging measures.

Our role as elder law and special needs attorneys also spreads to the courtroom. Our attorneys can represent you, or your loved one’s interests, in guardianship proceedings in order to establish an individual who can properly administer an incapacitated person’s personal and financial affairs. Our elder law services also include representing your interests in lawsuits involving appointment or removal of a guardian in addition to representation in will or trust contests.
